'Website' refers to Worker Label, accessible from www.workerlabel.co.nz

By accessing or using the service You agree to be bound by these Terms of Service. If You disagree with any part of these Terms of Service then You may not access the service.

You represent that you are over the age of 18. The company does not permit those under 18 to use the service.

Sale of Goods

 

These Terms and Conditions govern the sale of goods available on our Site.

The following goods are available on our Site:

• Perfume.

 

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

 

Payment

 

We accept the following payment methods on our Site:

 

• Credit Card; and
• PayPal.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

 

Shipping and Delivery

 

When you purchase goods from our Site, the goods will be delivered through one of the following methods:

• NZ Post.

 

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforseen circumstances. Please note that delivery times do not include weekends and statutory holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

If you purchase goods from us for delivery to a destination outside New Zealand your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

 

Refunds

 

Refunds for Goods

Refund requests must be made within 30 days after receipt of your goods.

 

Returns

 

Returns can be made by mail. To return a good by mail, follow the following procedure:

• Email us and request a return to base contract and wait for our response.

 

Consumer Protection Law

 

Where the Consumer Gurantees Act , and the Fair Trading Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

 

Intellectual Property Infringement

 

We respect the intellectual property rights of others. It is our policy to respond to any claim that content posted on the service infringes a copyright or other intellectual property infringement of any person.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the service, You must submit your notice in writing to the attention of our copyright agent via email legal@workerlabel.co.nz and include in your notice a detailed description of the alleged infringement.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any content is infringing your copyright.

The service and its original content (excluding content provided by other users), features and functionality are and will remain the exclusive property of the company and its licensors.

The service is protected by copyright, and other laws of New Zealand.

Our copyright and material may not be used in connection with any product or service without the prior written consent of the company.

Our service may contain links to third-party web sites or services that are not owned or controlled by the company.

The company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

Termination

 

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms of Service.

Upon termination, your right to use the service will cease immediately. If You wish to terminate your account, you may simply discontinue using the service.

 

Governing Law

 

The Laws of New Zealand, shall govern these terms and your use of the service. Your use of the application may also be subject to other local or national laws.

 

Disputes Resolution

 

If You have any concern or dispute about the service, you agree to first try to resolve the dispute informally by contacting the company.

We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
